Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Kibin, Inc. ("Kibin," "we," "us," or "our") governing your access to and use of the Kibin websites, mobile applications, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

ARBITRATION NOTICE: Except for certain disputes described in Section 17, you agree that disputes between you and Kibin will be resolved by binding, individual arbitration, and you waive your right to a jury trial or to participate in a class action.

1. Our Services

Kibin operates two distinct services under these Terms:

• Kibin Study App — an AI-powered study platform (mobile and web) that turns your notes, documents, audio, and video into quizzes, flashcards, explanations, and mastery tracking.
• Kibin Essay Editing Service — professional essay editing and proofreading services, along with the Essay Examples Library, Paper Grader, Thesis Generator, and related writing tools.

Some sections of these Terms apply to both Services; others apply only to one. Where a section is specific to one Service, we say so.

2. Eligibility

The Services are not available to users under 13 years old. If you are between 13 and 18 (or the age of majority in your jurisdiction), you may use the Services only with the consent of a parent or legal guardian who agrees to these Terms on your behalf.

3. Your Account

You must provide accurate information when creating an account. You are responsible for all activity under your account and for keeping your authentication credentials secure. Notify us immediately at help@kibin.com if you suspect unauthorized access to your account. You agree not to impersonate any other person or entity or use an inappropriate username.

4. License to Use the Services

Subject to these Terms, Kibin grants you a non-transferable, non-exclusive, revocable, limited license to use the Services for your own personal, noncommercial use. You may not: (a) sell, rent, lease, or commercially exploit the Services; (b) reverse engineer, decompile, or disassemble any part of the Services; (c) access the Services to build a competing product; (d) copy, reproduce, or distribute any part of the Services; or (e) use the Services for chain letters, junk mail, spamming, or bulk unsolicited communications.

5. Subscriptions and Payments

5.1 Study App Subscriptions (Pro)

Certain Study App features require a paid subscription ("Pro"). Subscriptions are available on weekly, monthly, and annual billing cycles and are processed through Stripe (for web and Android) or the Apple App Store (for iOS). Prices are displayed at the time of purchase.

5.2 Essay Examples Library Subscription

The Essay Examples Library subscription grants monthly or yearly access to thousands of essay examples. Each Essay Examples Library subscription also includes Kibin Editing Credits that can be used for Kibin's essay editing service. Credit balances do not roll over between billing periods and expire at the end of the subscription period if unused.

5.3 Per-Order Essay Editing

Essay editing services may also be purchased on a per-order basis without a subscription. Each order is charged upfront via the payment method you select.

5.4 Free Trials

We may offer free trial periods. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan and you will be charged. Trial eligibility is limited to one per person. If you delete your account and re-register, you may not be eligible for another free trial.

5.5 Billing and Renewal

Subscriptions automatically renew at the end of each billing period unless canceled. You authorize Kibin to automatically charge the payment method on file until the subscription is cancelled. Annual subscriptions renew one year after the initial subscription date; annual subscribers will be notified of renewal via email 30 days before the annual subscription fee is charged.

You can cancel at any time through your account settings, the Stripe customer portal, the Apple App Store, or by emailing help@kibin.com. Cancellation takes effect at the end of the current billing period.

5.6 Subscription Pause (Essay Examples Library)

Essay Examples Library subscribers may pause the subscription for 1, 2, 3, or 4 months. While paused, access to Library content and editing credits is suspended. The subscription automatically resumes at the end of the selected pause period; you are responsible for canceling before resume if you no longer want the subscription.

5.7 Price Changes

We may change subscription prices with reasonable notice. Price changes take effect at the start of your next billing period after the change.

5.8 Taxes

Prices do not include taxes. You are responsible for any applicable taxes associated with your subscription or purchase.

6. Refunds

6.1 Subscription Refund Policy

Once Services have been accessed, viewed, or downloaded using a subscription, the initial subscription fee and all recurring charges are non-refundable except as required by law. Subscriptions that are not cancelled prior to the renewal date are ineligible for refunds upon cancellation. Unused time on an active subscription is not eligible for a refund. Subscription fees for accounts found to be abusing the Services are non-refundable.

6.2 Essay Editing Refund Policy

Refunds are not given for any plagiarized work submitted to Kibin's editing service. Miscategorized editing orders are not eligible for cash refunds; customers will be notified if their order does not qualify for the service selected and will be given the option to apply an account credit equal to the initial payment to a new order using the correct service.

7. Your Content

7.1 Ownership

You retain ownership of content you upload to the Services ("User Content"), including notes, documents, audio files, essays, and other materials. You are solely responsible for your User Content and for ensuring you have the right to upload it.

7.2 License to Kibin

By uploading User Content, you grant Kibin a non-exclusive, royalty-free, worldwide license to use, process, store, display, and (where necessary to provide the Services) transmit your User Content to third-party service providers. For the Study App, this includes processing your content through AI services to generate quizzes, flashcards, summaries, and explanations. For the Essay Editing Service, this includes sharing your submission with editors working on your order.

7.3 Deletion

You may delete your User Content at any time. When you delete your account, we delete your User Content in accordance with our data retention policies. Some data may be retained as required by law or for legitimate business purposes (such as preventing free tier abuse, fraud prevention, or tax and accounting records held by our payment processors).

7.4 Acceptable Use

You agree not to upload or submit any content that: (a) is unlawful, infringing, harassing, libelous, defamatory, abusive, threatening, harmful, vulgar, obscene, profane, sexually oriented, racially offensive, or otherwise objectionable; (b) violates any law, rule, or regulation; (c) infringes, misappropriates, or violates any copyright, trademark, or other intellectual property right, right of privacy, or right of publicity; (d) encourages conduct that could constitute a criminal offense; (e) advertises or solicits commercial transactions; or (f) encourages the use of controlled substances. You also agree not to (g) attempt to bypass security measures or usage limits, (h) use automated tools to scrape or extract data from the Services, (i) use the Services for commercial transcription, content generation, or resale, or (j) impersonate any other person or entity.

8. Content Sharing Policy

Kibin reserves the right to use User Content uploaded through public-facing Services for promotional, educational, or other business needs. When Kibin uses content in this manner:

• Content will never be used earlier than 90 days after being uploaded.
• Customers who pay for editing services are opted out of content sharing by default.
• You can check your content-sharing settings or opt out at any time through your account preferences.
• Kibin will never use or share the following types of content in this manner: business documents or materials, press releases, personally identifiable content, and copyrighted content including books, novels, short stories, and poems.

When you upload content through Kibin's Free Contributor program or Paper Grader service, you grant Kibin a perpetual, irrevocable, and exclusive right to the submission. Paper Grader submissions will not be published earlier than 90 days after being uploaded.

9. AI-Generated Content

The Study App uses artificial intelligence to generate study materials including quizzes, flashcards, summaries, and explanations. AI-generated content is provided for educational purposes only. While we strive for accuracy, AI-generated content may contain errors, omissions, or inaccuracies. You should not rely solely on AI-generated content for academic, professional, medical, legal, or financial decisions. Kibin is not responsible for any consequences of relying on AI-generated content.

10. Intellectual Property

The Services and their original content (excluding User Content), features, and functionality are owned by Kibin, Inc. (© 2010-2026, all rights reserved) and are protected by copyright, trademark, and other intellectual property laws. Kibin's trademarks, service marks, logos, icons, graphics, and trade dress may not be used without our prior written permission. You may not remove copyright, trademark, or other notices from any materials obtained from the Services.

11. Copyright Infringement Claims (DMCA)

If you believe that your copyrighted work has been infringed on the Services, please send a written notification of claimed infringement to team@kibin.com with the following information:

• An electronic or physical signature of the person authorized to act on behalf of the copyright owner
• A description of the copyrighted work that you claim has been infringed
• A description of where the allegedly infringing material is located on the Services
• Your telephone number, address, and email address
• A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
• A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf

Upon receiving a proper notice, Kibin will promptly remove the allegedly infringing material.

12. Account Deletion and Abuse Prevention

You may delete your account at any time through Settings. When you delete your account, we delete your personal data and study materials. However, we retain a record of your email address and usage history to prevent abuse of our free tier. If you re-register with a previously deleted email, you may not be eligible for a free upload or free trial.

13. Communications

Any information or communication you send to Kibin via the Services or email (other than information sent through secure areas of the Services) is not confidential, and Kibin may use it without restriction or compensation to you. You represent that anything you submit is original to you and that you have the right to submit it.

By calling or texting us at 888-885-4246, you agree to receive text messages from Kibin. You can opt out of text messages at any time by replying "STOP."

14. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. KIBIN DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. KIBIN DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY AI-GENERATED CONTENT OR EDITORIAL FEEDBACK. IT IS YOUR RESPONSIBILITY TO TAKE PRECAUTIONS AGAINST VIRUSES AND OTHER HARMFUL CODE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIBIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF KIBIN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. KIBIN'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO KIBIN IN THE 12 MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS, SO THEY MAY NOT APPLY TO YOU IN FULL; IN SUCH CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

16. Indemnification

You agree to defend, indemnify, and hold Kibin (and its officers, directors, employees, and agents) harmless from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to (a) your use of the Services, (b) your User Content, or (c) your violation of these Terms.

17. Dispute Resolution

17.1 Arbitration

Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall take place in San Luis Obispo County, California, or remotely as agreed by the parties. The arbitrator's decision is final and binding.

17.2 Class Action Waiver

You agree to resolve disputes with Kibin on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding.

17.3 Opt-Out

You may opt out of the arbitration agreement by sending written notice to help@kibin.com within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out.

17.4 Exceptions

Either party may bring claims in small claims court. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

18. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services ceases immediately and you must destroy any materials downloaded from the Services. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

19. General

• Governing law: These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
• Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kibin regarding the Services and supersede all prior agreements.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• No waiver: Our failure to enforce any right does not waive that right.
• Assignment: You may not assign these Terms. Kibin may assign these Terms in connection with a merger, acquisition, or sale of assets.
• Changes: We may update these Terms from time to time. Material changes will be communicated through the Services or by email. Continued use after changes constitutes acceptance.
• External links: The Services may link to third-party websites. Kibin does not operate, control, endorse, or approve those sites or their content.
